PERSONAL DATA PROTECTION AND PRIVACY POLICY

1. PRINCIPLES FOR PROCESSING PERSONAL DATA

Welcome to Tedsuite. This Privacy Policy explains how Tedsuite Teknoloji A.Ş. ("Tedsuite," "we," "us," or "our") collects, uses, shares, and protects information in relation to our mobile application "Tedsuite" (the "App") and its related services (collectively, the "Service").

This Policy applies to all visitors, users, and others who access the Service ("Users," "you"). By using our Service, you understand and agree that we are providing a platform for you to communicate, and you consent to the collection and use of your information as described in this Privacy Policy. This policy is prepared in compliance with the Turkish Personal Data Protection Law No. 6698 ("KVKK") and, where applicable, the EU General Data Protection Regulation ("GDPR").

2. PRINCIPLES FOR PROCESSING PERSONAL DATA

In accordance with the KVKK, we process personal data based on the following fundamental principles: a. Lawfulness and Fairness: Processing data in compliance with the law and principles of good faith. b. Accuracy and Being Up-to-Date: Ensuring that personal data is accurate and updated where necessary. c. Purpose Limitation: Processing data for specific, explicit, and legitimate purposes. d. Data Minimization: Ensuring data is relevant, limited, and proportionate to the purposes for which it is processed. e. Storage Limitation: Storing data only for the period required by relevant legislation or for the purpose for which it is processed.

3. INFORMATION WE COLLECT

In accordance with Articles 5 and 6 of the KVKK, we may process the following types of information to provide and improve our Service, with your consent or where legally permitted without consent.

A. Information You Provide Directly:

  • Account and Identity Information: When you create an account, we collect information such as your name, surname, phone number, and email address to identify you and secure your account.

  • Profile Information: You may choose to add a profile picture or a status message to your account.

  • User Content: We process any information you voluntarily create within the App, such as your contacts or group lists.

  • Communications with Us: We collect information you provide when you contact us for customer support or other inquiries.

B. Information We Collect Automatically:

  • Voice Data: The content of your push-to-talk communications is transmitted through our servers to be delivered in real-time. We do not record or store the content of your voice communications after they have been successfully delivered. The data exists on our servers only transiently for the purpose of transmission.

  • Usage Data & Technical Information: We collect service-related diagnostic and performance information. This includes your Internet Protocol (IP) address, device identifiers (including Advertising ID), device model, operating system information, App version, log files, crash reports, performance logs, and general location information derived from your IP address.

C. Mobile Device Permissions: To provide the core functionality of the App, we may request access to certain features on your device. You will be prompted to grant these permissions:

  • Microphone: Essential for capturing your voice for push-to-talk communications.

  • Push Notifications: To alert you of incoming communications and other service-related updates.

  • Contacts: To allow you to easily find and connect with your contacts who also use the Service.

4. PURPOSES OF PROCESSING PERSONAL DATA

We process your personal data for the following legitimate purposes:

  • Providing and Operating the Service: To create and manage your user accounts, facilitate the core push-to-talk communication service, and connect you with other users.

  • Service Improvement: To analyze usage patterns, troubleshoot technical issues, and improve the stability, functionality, and features of our App.

  • Security and Integrity: To conduct security audits, verify accounts and activity, combat harmful conduct, and ensure the operational security of our Service.

  • Customer Relations: To manage customer support requests, answer your questions, and resolve any issues.

  • Legal and Contractual Obligations: To fulfill our obligations arising from our Terms of Service and to comply with all applicable legal and administrative requirements, including responding to valid requests from competent legal authorities.

5. LEGAL BASIS FOR PROCESSING (FOR EEA USERS)

If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal bases for doing so under applicable EU laws. The legal bases depend on the Services you use and how you use them. This means we collect and use your information only where:

  • It is necessary for the performance of a contract to which you are a party (e.g., to provide you with the push-to-talk service as described in our Terms of Service).

  • It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to improve the service, and to protect our legal rights and interests.

  • You give us consent to do so for a specific purpose (for example, to access your contacts).

  • We need to process your data to comply with a legal obligation.

 

 

6. SHARING AND TRANSFER OF PERSONAL DATA

In line with the purposes stated in this Policy and in compliance with Articles 8 and 9 of the KVKK, we may transfer your personal data to:

  • Other Users: Your profile information (name, picture) and online status may be visible to other users you communicate with or who are in your contact/group lists.

  • Service Providers & Business Partners: Third-party vendors, suppliers, and subcontractors who provide us with essential services such as cloud hosting, data storage, infrastructure, security, and analytics. These parties are contractually obligated to protect your data and only process it according to our instructions.

  • Group Companies: We may share information within our family of companies for internal administrative purposes and provide a cohesive service.

  • Official Authorities: Competent legal authorities, courts, and other government agencies when required by law or to respond to a valid and binding legal process.

 

7. INTERNATIONAL DATA TRANSFERS

Your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ. If you are located in the EEA, we will ensure that any transfer of your personal data to a third country is subject to appropriate safeguards, such as Standard Contractual Clauses approved by the European Commission.

8. METHOD OF COLLECTION & COOKIES

We collect your personal data through automated and non-automated means, including when you create an account, use the App's features, and interact with our Service. This includes data you provide directly and data collected automatically via the App and its underlying technologies, including Software Development Kits (SDKs).

9. DATA SECURITY

In accordance with Article 12 of the KVKK, we take all necessary technical and administrative measures to ensure an appropriate level of security to prevent unlawful processing of, or unlawful access to, your personal data, and to ensure its preservation. These measures include, but are not limited to, using SSL encryption, firewalls, up-to-date anti-virus systems, and implementing strict access authorization controls.

10. DATA RETENTION PERIOD

We retain personal data only for the period specified in relevant laws or for the period necessary for the purposes for which they are processed. When the purpose of processing ceases to exist or the legal retention periods expire, we delete, destroy, or anonymize the personal data in accordance with our internal policies and legal obligations.

11. YOUR RIGHTS AS A DATA SUBJECT

Under Article 11 of the KVKK, you have the right to:

  • Learn whether your personal data is being processed.

  • Request information if your personal data has been processed.

  • Learn the purpose of the processing and whether it is used in line with its purpose.

  • Know the third parties to whom your personal data is transferred, in Turkey or abroad.

  • Request the correction of your personal data if it is incomplete or incorrectly processed.

  • Request the deletion or destruction of your personal data under the conditions stipulated in Article 7 of the KVKK.

  • Request that correction, deletion, or destruction operations be notified to third parties to whom your personal data has been transferred.

  • Object to a result against you that arises from the analysis of processed data exclusively through automated systems.

  • Request compensation for damages in case of unlawful processing of your personal data.

To exercise these rights, you may contact us by sending a request to kvkk@tedsuite.com. We will respond to your request free of charge as soon as possible and within thirty (30) days at the latest.

12. CHILDREN'S PRIVACY

Our Service is not intended for or directed at individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information, we will take steps to delete such information.

13. CHANGES TO THIS POLICY

We may modify or update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy within the App or on our website. Your continued use of the Service after any modification will constitute your acceptance of such modification.
